Pursuant to the Family Code, travel cost can be an additional element of child support. This is determined on a factual basis, and each and every case is different. The normal travel cost normally associated with custody is either air fare or possibly the expense to drive one's car a great distance for visitation. The code allows for these costs to be apportioned in the case where one party earns a great deal more than the other party, or where appropriate.
Our firm is aware that travel cost assignments are completely at the discretion of the court, and therefore, the equitable issues of fairness are important with regards to travel costs.
