Medical Costs in divorce - who pays?

The Law Office of David C. Stone knows that medical costs for minor children is a problem with many families. Our office has developed the best plan on how to present reimbursement issues, and what is reasonable and necessary.

Medical costs can be ordered as additional support for the minor children pursuant to Family Code §4061 and Family Code §4062 . Pursuant to the Family Code, both parties have an obligation to insure the minor child if insurance is offered through their employment at a reasonable rate, and it is assumed to be reasonable if it is a group plan. Furthermore, both parties have an obligation for all uninsured medical costs. Medical costs will include not only medical procedures but also dental, vision, and psychiatric care. Pursuant to the Family Code, all medical procedures must be reasonable and necessary before the other party is obligated.
