Assets and Debts

Assets and Debts are established through a process set up by the Family Code called a Declaration of Disclosure, which each party indicates to the other party what assets and debts are involved in the dissolution of marriage. A further process of discovery is also utilized to determine the values and the existence of certain assets and debts.

Once all assets and debts are established and characterized as either Community Property or Separate Property, they are normally easily divisible. If an agreement cannot be reached at time of trial, both parties will present their evidence to the nature of both assets and debts, its characterization, and how they believe assets and debts should be divided.
